In his recent book “The Constitution of the War on Drugs” (Oxford University Press, 2024) Columbia Law School Professor David Pozen provides a critical account of the “war on drugs”, showing how it was shaped by constitutional law – and how constitutional law was shaped by it. The book uses drug disputes to illuminate the U.S. constitutional order’s mix of legal liberalism and punitive paternalism, and provides a roadmap to constitutional reform options available today, informed by approaches taken by courts in several different countries.

 

In this webinar, Prof. Pozen will present the main arguments of the book, and discuss it with the audience. The Supremo Tribunal Federal’s recent decision on drug possession will provide the backdrop for a discussion on the constitutional aspects of the “war or drugs” considering a Brazilian perspective.
